April 9, 2005 meeting called to order by Timothy Ross, Chairman

Town Board Liaison: James Ross

The minutes of March 9, 2005 were reviewed. There were no additions/corrections. Upon motion by Timothy Ross and seconded by Corinne Weber, the minutes were accepted 6-0 upon roll call vote.

Planning Board minutes: A discussion amongst the Board members was had concerning Michelle Greig and her qualifications again arose. The Secretary was instructed to write to the Planning Board and inquire as to Ms. Griegs qualifications.

ZEO memos: There were no comments.

Building permits were reviewed with no remarks.

Review Appeal 05-04 Jacqueline Holsapple request for a lot line alteration by conveying 0.097 acre to Glen Coon which would reduce the applicant’s non-conforming lot of 0.800 acre to a more nonconforming lot of 0.702 acres. Mr. Coon obtained a survey when an issue with a shed on his property arose and this showed that an addition to Mr. Coons home was on property owned by Mrs. Holsapple. The mistake was made by both parties thinking that a monument marked the property line. In actuality, this monument was well on Mrs. Holsapple’s property. Moving of the line is necessary to place the residence on lands owned by Mr. Coons.
A Public Hearing was scheduled for May 11 at 7:20.

Continuation of Public Hearing Appeal 05-03 David Podolsky application for an area variance to construct a 36’ x 36’ building to be occupied by a home occupation for motorcycle accessories, the storage of samples for shows and exhibitions and the sewing of racing tire warmers. The applicant would further ask for a variance to have more than one employee. §143-32 D states “The home occupation activity, whether located within the dwelling or in a customary accessory structure, shall, in accordance with the requirements of the New York State Uniform Fire Prevention and Building Code, occupy no more than five hundred (500) square feet of gross floor area or twenty-five percent (25%) of the gross floor area of the dwelling on the premises, which ever shall be the more restrictive.” §143-32H states “Not more than one (1) person other than members of the household occupying such dwelling shall be employed on the residential premises in the conduct of the home occupation.” The applicant failed to appear, however the Chairman permitted remarks from those who were present in the audience who wished to speak about the proposal. Maryann Johnson raised the question that perhaps a use variance was necessary to permit the addition of more than one employee outside of the household. Ms. Johnson further submitted a letter to the Board opposing this project which will be read at next months meeting and entered into the minutes. Pamela Veach, another neighbor also opposed to the project stating that it was commercial in nature with goods being manufactured and sold out of the building, more than two people being employed and the area being residential. This appeal was tabled to May 11 at 8:40. The secretary was instructed to write to the applicant advising him to appear on this date at the specified time or his application will be considered to have been withdrawn.

Review Appeal 05-05 TKB LLC Keith Lore, Brad Keil and Steve Tinkelman, architect for the project were present. Mr. Tinkelman presented the proposal for a project aimed for traditional/development, new/urbanism. The project will extend in 6 acres in the Village and 5 or 6 acres in the Town. The Village will be lead agency. 5 variances from the Town Zoning Board of Appeals will be needed. There will be a Home Association with 39 dwelling units in the Town with 14 dwellings in the Village. Most of the homes will have two bedrooms and 2 bathrooms. The project will offer more clustered living, more open space, pedestrian friendly community, service roads behind the homes. The lot size is smaller than that permitted in the zoning code which requires variances for lot size, set back requirements and
coverage. A Public Hearing is scheduled for 7:30 May 11th.

As there was no further business to come before the Board, upon motion by Timothy Ross seconded by Corinne Weber, and unanimously carried, the meeting was adjourned.
