Zoning Board of Appeals Meeting Minutes
July 14, 2004
July 14, 2004 meeting called to order by Timothy Ross, Chairman
Roll call: Members present: Jeanne Douglas, Corinne Weber, Kenneth Anderson,
Gordon Denegar
Members absent: James O’Toole, Michael Mosher
Town Board Liaison: James Ross
The minutes of June 9, 2004 were reviewed . Jeanne Dougals noted that an
addition should be made as follows: The Board reviewed the short EAF part 1
submitted by the applicant. The Board completed part 2 and found that there
would be no significant environmental impact. Upon motion by Corinne Weber,
seconded by Ken Anderson, the minutes with the foregoing addition were
unanimously accepted upon roll call vote.
Planning Board minutes: No comment
ZEO memos: Mr. Cole did not know the status of the complaint regarding the Red
hook Land Corporation matter. He advised that the cars on the Brown property
had been removed.
Building permits were not reviewed.
Rosemary Zengen was present and asked to address the Board. She is concerned
that the zoning law is being flouted and the remedy seems to be its okay, just
make application to the ZBA and get a variance. Apparently Glen Coon, an
adjoining neighbor, built a shed on her line without a building permit and was
told by the building inspector to go before the ZBA for a variance to cure the
violation. She feels that there should be a penalty of some sort for this type
of offense. Tim Ross advised Ms. Zengen that Mr. Coon had been in for three
other variances and knew the law and why he did not get a permit this time was
unknown. Corinne Weber noted that the last time Mr. Coon had been granted a
variance, he was told not to come back for any further variances. Jeanne
Douglas stated that she agreed with Ms. Zengen and that penalties should be
administered to those who did not follow the zoning law.
Public Hearing Appeal 04-10 John Carroll application for a variance to the
side yard requirements. The applicant wants to construct a 24’ x 24’ 2 story
garage 10’ from the side property line. The zoning law requires 20’ for
accessory buildings in the RD3 zoning district. Mr. Carroll advised the Board
that he prefers the garage in front of the house rather than in the rear so as
not to lengthen the driveway. The garage is to be two story so as to match the
design of the house. The Public Hearing was opened and as there was no comment
from the public, closed. After discussion by the Board, Tim Ross made a motion
to grant the 10 foot side yard variance to be used solely for a garage and
storage with electric but no plumbing. This was seconded by Gordon Denegar and
unanimously passed by the following roll call vote.

Review Appeal 04-11 John Holzmann request for an area variance to add a 1000
sq. ft. addition to their present home. The maximum coverage allowed in the
RD3 zone is 7%. This addition will bring total coverage to 12.8. The Chairman
has scheduled August 18th at 7:20 for a Public Hearing.
Appeal 04-08 Red Hook Boat Club. A Public Hearing was conducted June 9th and
an eight foot variance granted based on the Building Inspector’s denial
stating that the zoning law required a 25 foot setback. The setback
requirement was incorrect and the variance should have been based on a 50 foot
setback. After a short discussion, Corrine Weber made a motion to grant a 33
foot variance to the Boat Club based upon all the prior stated reasons. This
was seconded by Kenneth Anderson and unanimously carried by the following roll
call vote:

Review Appeal 04-13 Matthew Wallace, Wendy Nesel and Mary Loeffel request for
an area variance to erect a single family dwelling 0 feet from that point at
which the flag lot first achieves its minimum lot width. The required front
setback is 50 feet from said line per Section 143-21C2. The proposed septic
system, 100% reserve area and silt fence requirement prevent placement of
house elsewhere on the lot.
As there was no further business to come before the Board, upon motion by
Timothy Ross, seconded by Corinne Weber and unanimously carried, the meeting
was adjourned.
